PRIVACY POLICY, ASSUMPTION OF RISK & LIABILITY WAIVER

This Privacy Policy and Liability Waiver (“Agreement”) applies to all participants, clients, members, users, parents/guardians, and visitors (“you” or “Participant”) engaging with any services, programs, facilities, websites, or mobile applications operated by or affiliated with:

• Coach Holley Fit (App & Digital Services)

• Absolute Body Armor (Facilities & Training)

• Absolute Armor Mentoring Program (AAMP)

• Empowering Diverse Minds (E.D.M.) – ABA Therapy Services

• All affiliated staff, contractors, volunteers, and locations

(collectively, “we,” “us,” or “the Company”).

By accessing our facilities, participating in programs, using our app, or submitting information to us, you acknowledge, accept, and agree to the terms below.

1. WHAT THIS AGREEMENT COVERS

This Agreement governs:

• Physical training, fitness activities, sports performance, and workouts

• Mentorship, coaching, behavioral services, and ABA therapy

• Facility use (gyms, training spaces, equipment, common areas)

• Digital platforms, websites, mobile apps, messaging, and communications

• Programs involving both minors and adults

2. PERSONAL INFORMATION WE COLLECT

We may collect personal information including, but not limited to:

• Identity & Contact Information: Name, phone number, email, address, date of birth

• Health & Fitness Information: Height, weight, fitness metrics, injury history, therapy notes (as applicable)

• Program Data: Attendance, progress notes, mentorship records, behavior plans

• Digital Data: App usage, device identifiers, IP address, location data (if enabled)

• Payment Information: Processed securely through third-party payment providers

• Media: Photos, videos, audio recordings taken during training or events

3. MINORS & PARENTAL CONSENT

Programs may involve participants under 18 years old.

By enrolling a minor, the parent or legal guardian:

• Confirms legal authority to consent

• Approves participation in all physical, mentorship, and therapeutic activities

• Authorizes collection and use of the minor’s information as outlined

• Accepts responsibility for the minor’s conduct and participation

We do not knowingly collect information from minors without parental consent.

4. HOW WE USE INFORMATION

We use personal information to:

• Deliver training, mentorship, therapy, and digital services

• Maintain safety, program quality, and progress tracking

• Communicate updates, schedules, and program information

• Process payments and manage accounts

• Improve our services, systems, and user experience

• Comply with legal, insurance, and regulatory obligations

5. INFORMATION SHARING

We may share information only as necessary with:

• Coaches, therapists, mentors, and staff

• Third-party service providers (payments, app hosting, analytics)

• Insurance carriers or legal authorities if required

• Medical personnel in case of emergency

We do not sell personal information.

6. DIGITAL SERVICES & COOKIES

Our websites and apps may use cookies, analytics tools, and similar technologies to improve functionality and performance. You may manage cookie preferences through your device or browser settings.

7. ASSUMPTION OF RISK

You acknowledge that participation in physical training, sports activities, fitness programs, mentorship sessions, and facility use involves inherent risks, including but not limited to:

• Muscle strain, sprains, fractures

• Cardiovascular events

• Equipment-related injuries

• Slips, falls, or collisions

• Emotional or psychological discomfort during coaching or therapy

You voluntarily assume all risks, known and unknown, associated with participation.

8. MEDICAL CLEARANCE & RESPONSIBILITY

You affirm that:

• You (or your child) are physically and mentally able to participate

• Any medical conditions, injuries, or limitations have been disclosed

• You will immediately stop participation if unsafe or advised

The Company does not provide medical advice.

9. RELEASE OF LIABILITY

To the fullest extent permitted by law, you release and hold harmless Coach Holley Fit, Absolute Body Armor, AAMP, E.D.M., and all affiliated parties from any and all claims, including:

• Injury, illness, or death

• Loss or damage to personal property

• Emotional or psychological distress

• Negligence (except gross negligence or willful misconduct where prohibited by law)

10. FACILITY & EQUIPMENT USE

Participants agree to:

• Follow all posted rules and staff instructions

• Use equipment properly and safely

• Respect staff, participants, and property

The Company is not responsible for lost, stolen, or damaged personal items.

11. MEDIA RELEASE

You grant permission for photos, videos, and audio recordings taken during participation to be used for:

• Marketing

• Education

• Social media

• Promotional materials

Unless a written opt-out is submitted.

12. DATA SECURITY

We use reasonable safeguards to protect information but cannot guarantee absolute security. Electronic transmission carries inherent risk.

13. DATA RETENTION

Information is retained only as long as necessary for business, legal, or program purposes.

14. YOUR RIGHTS

You may request to:

• Access or correct personal information

• Withdraw consent (where applicable)

• Opt out of marketing communications

15. GOVERNING LAW

This Agreement is governed by the laws of the State of California, without regard to conflict of law principles.
